Experience

Multinational Biotechnology Company: The Client is a multinational biotechnology firm specializing in the development, manufacturing, and commercialization of solutions for animal and environmental health. In this matter, Dentons LuatViet provided legal counsel and drafted cease-and-desist letters to a Vietnamese importer and distributor, demanding that they immediately discontinue the unauthorized use of the Client’s trade name and protected trademark in their advertising materials for products that constitute unfair competition.
US-based Life Sciences Firm: Offered comprehensive advice on IP protection strategies, including patent registration and regulatory compliance for pharmaceutical products in Vietnam.
Lam Soon Singapore Pte Ltd: Advised on the protection and maintenance of international trademark registration in Vietnam, ensuring compliance with local laws.
Gazprom: Assisted in securing and protecting international trademark registration in Vietnam, ensuring compliance with the local regulatory framework.
Russian Steel Distributor: Advised on trademark registration procedures, including filing applications and following up with relevant authorities to secure the trademark in Vietnam.
Technology Consulting Company: Provided counsel on patent protection strategies and ensured compliance with Vietnam's intellectual property regulations.
Japanese health and beauty brand: The Client, a leading producer of health foods in Japan with No. 1 market share, operates through a nationwide network of more than 50,000 dealers. In connection with this matter, Dentons LuatViet assisted the Client in authorizing its exclusive Vietnamese distributor to enforce intellectual property rights on the Client’s behalf within Vietnam, in accordance with the terms of the Distribution Agreement.
US-based Nutritional Supplements Company: Provided legal counsel on trademark enforcement in Vietnam, conducting investigations, leading successful raids on counterfeit supplement products, and securing favorable rulings in civil proceedings. This resulted in the destruction of fake goods and compensation for damages.
International Technology Firm: Assisted a global tech company in enforcing its software copyright in Vietnam. Our team led enforcement actions against unauthorized distributors, resulting in significant fines and the removal of pirated software from the market.
Japanese Electronics Manufacturer: Represented a major Japanese electronics company in an intellectual property dispute, where we enforced its patent rights against unauthorized reproduction of its technology. We achieved a favorable outcome through litigation, with infringers facing financial and legal penalties.

Vietnam: Under the Decree No. 147/2024/ND-CP dated 09 November 2024 (“Decree 147”) replacing Decree No. 72/2013/ND-CP, foreign organizations and individuals providing cross-border information, app stores, games and social networks must comply with the provisions on licenses, reporting regimes and other regulations.

European Union's Artificial Intelligence Act – from Vietnam's perspective

Vietnam: On March 13, 2024, The European Parliament granted approval to the Artificial Intelligence Act (“AI Act” or “Act”), marking a significant milestone in the area of Artificial Intelligence (“AI”). This law is an innovative attempt to provide a legal structure for the utilization of AI within the European Union (“EU”) and place an emphasis on responsible development and execution, giving particular attention to trustworthiness, safety, and ethical factors in the field of creating and/or using AI. While the legislation must undergo a few more steps before it is enacted, it is expected to come into force in April or May this year and, following a 24-month grace period will be fully in force by around June 2026.

New Decree-Guidance on the amendments of Vietnam Intellectual Property Law 2022

August 29, 2023

Vietnam: Therefore, together with Decree No. 17/2023/ND-CP dated April 26, 2023, detailing several articles and implementation of the Intellectual Property Law regarding copyrights and related rights, Decree No. 65 will establish a complete legal framework, a necessary basis for the implementation and enforcement of the Intellectual Property Law (amended and supplemented in 2022).
